1. Acceptance of Terms

By accessing or using ReplyBrain ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users, including creators, brands, and affiliates.

2. Description of Service

ReplyBrain provides an AI-powered customer engagement platform that automates responses to Instagram comments, DMs, and story reactions. The Platform connects to your Meta/Instagram account to analyze and respond to engagement on your behalf.

3. Account Registration

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must be at least 18 years old to use the Platform.

4. Subscriptions & Billing

Paid plans are billed on a recurring basis as specified at the time of purchase. All payments are processed securely through Razorpay. You agree to:

• Provide valid and current payment information
• Pay all charges at the prices in effect when incurred
• Accept auto-renewal unless you cancel before the renewal date
• Review our refund policy as outlined on our pricing page

5. Acceptable Use

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate Meta's Platform Terms or Community Guidelines
• Send spam, misleading content, or automated abusive messages
• Attempt to reverse engineer, hack, or disrupt the Platform
• Use the Platform to harass, abuse, or harm others
• Exceed rate limits or API usage quotas

6. AI-Generated Content

ReplyBrain uses AI to generate responses. While we strive for accuracy and appropriateness, we make no guarantees about AI-generated content. You are solely responsible for reviewing and approving automated responses before they are sent. We are not liable for any damages arising from AI-generated content.

7. Intellectual Property

The Platform, including its code, design, branding, and proprietary technology, is owned by ReplyBrain. You retain ownership of your content and data. You grant us a license to process your data solely to provide the Service.

8. Limitation of Liability

To the maximum extent permitted by law, ReplyBrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account at any time for violation of these terms, illegal activity, or conduct that may harm other users or the Platform. Upon termination, your access to the Platform will cease immediately.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes via email or platform notice. Continued use after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved in the courts of [Your City, India].
